1. Overview
This website and online store are operated by LEVIX Pty Ltd as trustee for The LEVIX Trust (“LEVIX”, “we”, “our”, “us”). By accessing our website or purchasing from our store, you agree to be bound by these Terms of Service and our related policies, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
2. Eligibility and information
By placing an order, you confirm that you have the legal capacity to enter into a binding contract, or that you have permission from a parent or guardian. You agree to provide current, complete, and accurate information when placing an order.
3. Product information
We aim to present our products accurately. Minor variations in colour, finish, or appearance may occur due to lighting conditions, manufacturing processes, or screen display differences.
We may update product information, packaging, or availability from time to time. These updates will not affect orders that have already been confirmed and paid for.
4. Pricing and payment
All prices are listed in Australian dollars (AUD) and include GST where applicable. The price charged is the price displayed at checkout at the time you place your order.
Payments are processed securely through Shopify Payments and supported payment providers.
If a pricing or typographical error occurs, we reserve the right to cancel the affected order and issue a full refund. Where applicable, you may place a new order at the correct price.
5. Shipping and delivery
Orders are dispatched in accordance with our Shipping Policy. Delivery timeframes are estimates only and may vary due to factors outside our control, including carrier delays.
6. Returns, refunds and 30-Day Ritual Support
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
These statutory rights apply in addition to our 30-Day Ritual Support policy. Full details, including eligibility, conditions, and processes, are set out in our Return & Refund Policy.
The 30-Day Ritual Support is available on direct purchases via levix.au only and does not apply to purchases made through third-party retailers, marketplaces, or stockists.
7. Cancellations
Change-of-mind cancellations are not guaranteed.
If you wish to request a cancellation, you must contact hello@levix.au as soon as possible after placing your order.
Orders may only be cancelled if they have not yet been processed, packed, or dispatched. Once an order has entered processing, has been packed, or has been dispatched, it cannot be cancelled.
Where an order cannot be cancelled, it will be handled strictly in accordance with our Return & Refund Policy.
Nothing in this section limits or excludes any rights or remedies you may have under the Australian Consumer Law, including in relation to faulty or defective goods.
8. Consumer guarantees and warranty
LEVIX products are covered by consumer guarantees and other rights that may apply under the Australian Consumer Law.
If you believe a product has a manufacturing defect or fault, please contact hello@levix.au with your order details and a description of the issue.
9. Third-party services
Our store may use third-party services such as payment providers, analytics tools, or applications. These services operate under their own terms and privacy policies.
To the extent permitted by law, LEVIX is not responsible for third-party system outages or failures. This does not limit your rights under the Australian Consumer Law.
10. Prohibited use
- Violate any applicable laws or regulations
- Upload or transmit malicious or harmful code
- Interfere with the security or operation of the website
- Misuse or attempt to access the personal information of others
11. Limitation of liability
Nothing in these Terms limits any rights or remedies you may have under the Australian Consumer Law.
To the extent permitted by law, LEVIX is not liable for indirect or consequential loss arising from the use of our website or products.
12. Indemnity
You agree to indemnify LEVIX for losses reasonably arising from your breach of these Terms or unlawful misuse of the website, except to the extent that the loss was caused by LEVIX.
13. Changes to these Terms
We may update these Terms from time to time. Any updates apply to future use of the website and future purchases only.
Changes will not apply to orders that have already been placed and confirmed.
14. Governing law
These Terms are governed by the laws of Victoria, Australia.
